(York) — The family of a man who was shot and killed by a Northern York County Regional police officer after authorities said he approached with an AR-15 has commenced legal action against the department.

Lana Green, Isaiah Green’s mother, started the case on March 19 in the York County Court of Common Pleas. No complaint has been filed.

Police were called to a home on Kings Lane near Brownstone Drive in Dover Township for an “unknown problem” not long after 1:45 a.m. on Dec. 28, 2017.

Isaiah Green was in the garage. He had a rifle. A police officer shot and killed him after he approached, the Pennsylvania State Police said.

He was 21.

Neither Lana Green nor her attorney, Stephen Greecher Jr., could be reached.

Joe Santarone, an attorney who’s been retained to represent the Northern York County Regional Police Department, said he will have to see what’s included in the complaint.

In light of information he’s received, Santarone said it certainly appears that the officer’s actions were justified.

The Pennsylvania State Police is investigating the shooting, said Kyle King, a spokesman for the York County District Attorney’s Office, in a text message. District Attorney Dave Sunday will then make a determination about whether it was justified.
