Adams County DA charges man with “drug delivery resulting in death”, for first time ever

(Harrisburg) — A midstate prosecutor is filing charges against a man for providing heroin to someone who died from an overdose.

It’s the first case of its kind in Adams County.

The charges are known as drug delivery resulting in death.

31-year-old Brock Weaver allegedly sold drugs to Levi Blake Myers a day before he overdosed last year.

Adams County District Attorney Brian Sinnett says this is the first time he thinks he has the proof needed to convict someone of these particular charges.

“I mean you have to take the fact that somebody’s life is over because they ingested controlled substances, and I’m not ignorant to the fact that they did so willingly,” says Sinnett. “It’s a fact-specific determination. We had sufficient facts, provable facts that we could put in front of a judge or jury to establish all of the elements.”

Sinnett says he’s focused on the timeline between the drug exchange and the overdose, and wants to also make sure heroin was named as the primary cause of death.

If found guilty, Weaver could face up to 40 years in prison.

Prosecutors in other midstate counties have filed similar charges in other cases, as the opioid crisis claims more and more lives.

In recent years, a Carlisle man was sentenced to more than 34 years in prison on similar charges, and a Lebanon woman pled guilty and will spend up to 15 years in jail.
