(York) — York County’s District Attorney is pleading with Governor Tom Wolf to allow an execution of a man convicted of murderer.

DA Tom Kearney sent a letter to the governor arguing that granting a reprieve in Hubert Michael’s case would make a mockery of the judicial system.

Michael was convicted of kidnapping and killing Tricia Eng, a 16-year-old walking to a summer job in 1993.

Kearney says if there is a time to use the death penalty, this is it.

Wolf has issued a moratorium on executions.

Michael’s execution is scheduled for June 5th.

Governor Wolf’s spokesman Jeff Sheridan says Michael must be held to account, and says he will remain on death row until a commission finishes studying the death penalty.

Governor Wolf’s spokesman Jeff Sheridan’s full statement is below:

“Governor Wolf has the utmost sympathy for the families of victims of heinous crimes. Hubert Michael committed a monstrous crime and he must be held to account. His confinement to death row does not change as a result of Governor Wolf’s actions.

“The Governor has issued temporary reprieves in death penalty cases because he is concerned that the entire system is flawed, and he will await the report of the bi-partisan commission established by the Pennsylvania State Senate, and any recommendations and other concerns are addressed satisfactorily.”
